Can I get a British Passport?

My Husband of 33 years, was born in Britain and I was born in in South Africa. We live in Cape Town. Both my children have British Passports and are resident in London. I also have a grandfather who was born in Britain but do not have his paperwork as he died some years ago. Can I apply for a British Passport?

  1. About your grandad, you can get the paperwork.  It is all in public records and his birth certificate will be registered in England.

    Being a wife of a British subject does not give automatic right to citizenship but it is a basis on which your application will be considered and probably approved but there is a qualifying period during which you must live in England with your husband before you can apply.

    About the children I guess you could get permanent residency if they were in the UK based on their right to remain and your right to be with them as their parent.

    You should of course really discuss this with the immigration department at the British Embassy or at the Department of Immigration in England.

  3. Your children are British through their father but you're not. You need to apply for naturalization to become a British citizen. You would be better off applying for a spousal visa to get to the UK and then living there for 3 years and after that applying for citizenship.

    In regards to your grandfather if you can get his birth certificate, your birth certificate and the parent in question you may be able to qualify for an Ancestry visa.

    The main requirements for an Ancestry Visa are:

    you are a Commonwealth citizen

    you are aged 17 or over

    you have a grandparent who was born in the UK, the Channel Islands or the Isle of Man (see note below)

    you have a grandparent who was born in what is now the Republic of Ireland before 31 March 1922 (see note below)

    you are able to work and intend to do so in the UK, and

    you can support yourself and any dependants without needing any help from public funds.
