Can I get a divorce if he doesn't ?

we've been married 5years no kids no property no attachments...nothing!!!

  2. In the UK you can divorce after a 2 year separation by mutual consent. If one spouse will not agree the separation has to be 5 years and then the consent of the spouse is not needed.

  5. yep and it's cheaper that way. It's called an uncontested divorce.. if he agrees. If he dont and you have no property, it's called an uncontested divorce with a psycho

    And a contested divorce is where the both of you have property or something to split. Uncontested means that both parties want it. Contested means one dont but theres nothing that person can do. the timing matter. Uncontested is in a matter of the both of you signing the paper and the time it takes to file and get the judge to sign off on it. contested takes longer. My Uncontested divorce took a month and i think that's because we were in two different states.  If you want a divorce, contested, uncontested.. you can get it and be done.. it dont matter if he wants one or not.

  6. Yes, all you have to do is submit the petition with the divorce and if he does not respond to it then the judge will automatically grant it, if he does respond then you both have to go in front of the judge and explain why.

  10. You can get one but if he refuses to sign the papers, it can be a long, drawn out, expensive battle.  

  11. Yes, but if it is contested, it could take longer than normal.  In Florida we can go to the court house and get a divorce packet.  It contains all of the papers to fill out, papers for property,..all the stuff you need.  An uncontested divorce usually takes 30 days here.

  12. I think it depends on what state you are in.  Some states require that you have a reason for the divorce, but others (like mine, which is Michigan), have no-fault divorce, which means that either party can want to dissolve it without cause.

  14. Yes.  Rarely do both people want one.  Just get a lawyer, have him served with divorce papers, and go from there.

  15. Yes, you can file for a no-fault divorce. I was divorced earlier this year, and we had the same situation - no kids, property, et al.

    Depending on where you are too, you don't have to use a lawyer. You do have to file a motion for the divorce, which costs some money (he filed so I don't know how much).

    Check into the laws with your state, but I don't see it being a problem at all since you have no kids or property.

  17. You sure can and most court houses even have a form you can fill out for a Dissolution of Marriage (same thing as divorce). Just fill it out, pay the fee, file it, and wait for it to go through.
