Can I get a restraining order?

My husband has not hit me in 2 years, but regardless I need to leave him, as he intends to coerce me into another pregnancy.

As he is from overseas, and by way of his culture, men generally tend to abduct their children following a divorce, and taking them to their native country, I feel I have a legitamate fear that he will abduct my children. Is this enough grounds to seek a restraining order? He has strong familial and finacial ties to his country as well, plus the government actually aids its citizens with abducting their children from foreign mothers.

You may certainly seek one form the courts.  I hearing will determine if you get it or not.  I can tell you that people have received them for less cause then you have stated but the final determination will be up to a judge.  You would be better off asking this of a lawyer who practices in your state and has experience with family law or divorce law. You can petition for a restraining order on your own and there are many tools available on the internet to help you with it, there also may be local organizations that assist women in abusive relationships that could offer free help. My advice is to ask for legal advice from an attorney in your area because laws vary slightly from state to state and a local expert will have the specific information you need.  


  2. What a mess you have gotten yourself into. You picked him! Why on earth did you marry a man who you knew had the potential to steal your babies?  I say get away from him and change your identity.
