Can I get fired? If i don't sell enough warranty?

I AM A FURNITURE SALES PERSON IF I DONT SELL ENOUGH WARRENTY I CAN GET FIRED. IS THAT LEGAL?

  1. Yes you can be fired if your not doing your job, and if selling warrenties is part of your job then yes.  Companies don't want to pay you a salary if you are not productive.

If you have a contract that limits the employer's ability to fire you (and your ability to quit), you can enforce that.  Otherwise, you can quit or be fired for any reason or no reason.  Lack of production would most certainly be a good reason.  If you are hired to do a job, whether it be selling, or sweeping the floor, or running the whole company, non-performance is the best reason for firing someone.

  3. If it's not written down, yes, it's legal.

  4. bad news:  people can be fired for anything (almost).  if you've been at your job for over 90 days (probation period) they have to go through certain stages: warnings, etc, etc.  Likewise the employee can quit anytime - it's called "at will", meaning either party can divorce the other for any reason at all (possible exception: retaliation for blowing the whistle).

  5. Basically, if you have sales quotas and do not meet them they can certainly fire you.

    However in any state (right to work or not) they can fire you for the reason "Services no longer needed" without notice or reason.  As long as you are not getting fired for a protected reason (handicap, etc. it is legal)

    noitall...I find it rather funny that people come on here and put union rules as laws.  Most companies do not have any established probation period.  You work at will, and they fire you at will.  The 90 days, warnings, etc.  are union and contract rules...and have NOTHING to do with the law unless through breach of contract.  The only laws that protect employees from being fired (outside of contract positions) are non-discrimination laws.

  6. First, your all caps makes it seem as though you are yelling.  Second, yes you can be terminated for not selling enough warranties.  Most furniture sells itself, they don't need salesmen or saleswomen to move their product.  What the salesmen are for is to upsale and get extras like warranties, scotch guard ... etc.  As a salesperson you are most likely AT WILL, which means you can quit anytime and you can be let go at anytime for any reason.
