Can I get in trouble for keeping a baseball bat in the trunk of my car?

OK, for the past few years I've kept a wooden baseball bat in my trunk, for just in case moments. I've never used it on another person, though one time I had a road rager who who followed me and was going to accost me so I pulled out the bat to scare him off.

I was wondering, if a cop pulled me over and searched my car could I get in trouble for having the bat?

  5. Let's be honest, if your not out starting trouble you probably don't need a bat. A bat is not against the law though, a cop may still give you #&%^ for it though so maybe keep a glove and ball in your trunk too. You could also keep a big wrench back there, that's not illegal. Don't start trouble and you probably won't need your bat.

  6. No.  But if you got pulled over, he probably wouldn't search your car anyways unless he had probably cause of like drugs or something

    EDIT: well driving so tired that he thought you were high is pretty much probable cause for having drugs in your car

  7. Yes. Believe it or not, it's considered to be a weapon. I got pulled over once and the police officer told me to get rid of mine, which was in my trunk.

    I drive an SUV. It's easy to see it back there. For sports cars it's a little harder to see, but if someone does, at least here in NJ, you can get a ticket.

NO , it does not matte where you live, you can even have the bat in the passenger area of the car,  i have done it many times taking my kids to practice, and to games,   and just left there,  but you need to be sure you dont seem to be * grabbing *I it if they pull you over,  because then ,  that can be a different story,

  9. Oh yes, you can definitely get arrested for carrying a baseball bat.  Your jail time may even double if the find a pair of baseball cleats or a glove next to it.  Yes, that is sarcasm.  Baseball bats are still legal in America.

Phil t almost got it right; yes, baseball bats can be a weapon, but they are also used for baseball.  If you want to avoid any hassles just put a baseball glove next to the bat and, hey, you're player/fan who like to be ready for pick-up games.  There's no harm in that, but if you spike the bat with lead weights and nails sticking out of the sweet spot, that's bad.

  11. One of the general requirements for a concealed weapon charge would be that the weapon is immediately accessible.  if the bat is in the trunk and you would be required to exit your vehicle, open the trunk, and then remove it you would most likely be in the clear of a CCW charge.

  12. Would recommend that you carry a glove and a softball or two along with it, to support the context of frequent recreational use.

    For someone reason, when I work near the softball fields, I take a lot of people to jail for bats in their cars. They always seemed confused about it....

    and as long as it is in youre trunk no officer can just ask you to open your trunk they have to obtain either a search warrant or have a probable cause alternate to search your car.. u can also deny a search of your vehicle. just be smart about it... say no and tell him to go bang his ankles and come back with a warrant
