Can I get money back from careless landlord?

So, I just moved into a new apartment and in june i got a letter saying I got a $536 credit and to apply that to august's rent, we also had a reduce rent in july because of the offer we got for moving in when we did, anyways we just assumed that other credit for $536 was some of our deposit money back since we did pay alot for the deposit and planned to apply the 536 credit to august's rent , well about a week ago there was this issue and the rental agent told us that letter was a mistake and we didn't have a credit. My question is, this place made that mistake and with money so tight we used the extra 536 on something else and they want full rent, is there anything we can do to make them responsible for their mistake?

  1. You still owe rent.   The amount you owe does not change over a clerical error.    It is the same if the error went the other way, that you were behind the 536, the error would not somehow mean the landlord was entitled to the money.

    Their only responsibility is to apologize, they have no responsibly to give you the 536.


  2. Hi,

    Sorry but you still owe what is contracted through your lease.  If the Bank made a mistake in your favor would you assume they'd never catch the mistake!?  Never assume anything.

  3. They made a mistake - it does not relieve you from having to pay the rent that is legally and rightfully owed.
