Question:

Can I get my application fee back?

So me and a friend went for a "holding" on an apartment, paid the $100 admin fee(refundable) and two $45 applications fees(non-refundable) and we have no changed our mind and want out money back. We know for sure that they have not actually done anything with the applications because they cannot do that until we have a co-signer because they no for sure we will be denied because we do not have to income amount. So should I be able to get my full $190 dollars back because they did not actually go through with the application process yet? Also on the application they have a disclaimer at the bottom of the page saying you forfeit the money unless in is returned within ___ hours, and from what we recall the was no number filled in the little blank. so i was thinking just as a back up, we can go get a copy of the applications and then have proof right there that there was no number written in that blank.

What can I say is my reason for wanting to see my application, can i actually take them myself to go and make a copy because i do not want them to go behind our backs and fill in a number saying that there was a number in there the whole entire time. Just some feed back would be great, we are two teens who are student who also have part tiem jobs and really do not have that much money to throw around. We were think to just ask politly for the money back and if the deny it then to get nasty and threaten them with us calling the board of realtors or local newstations.

  1. You should get the $100 back upon request. There is no waiting period mentioned, a blank space with no initials, and no time commitment. You have a case for a refund.


  2. .   Try to get the entire amount back.  Tell them you talked to a guy who is a landlord who gives back the $45 if he hasn't done any work at all.  And you know they haven't done any work since you never gave them the final info.  Say it with a smile.  No threats.  Mention that you will be buying lunch for that person as soon as the checks are in your hand.  What do they want to eat?

    Next time i want you to write "100% refundable until cosigner sings." on all future checks.  If they haven't got the co-signer, you get the money with no questions.

  3. The $100 you can get returned to you. The $90 you can kiss goodbye without the immature and petty threats/demands. Grow up. You changed your minds and they are not legally obligated to return your non-refundable fees.

    Let this be a lesson to you that if you are not 100% sure on something you do not put money down.

  4. You will NOT get the application fees back.  That was clearly stated as non-refundable.  "Non-refundable" means just what it says.  The $100 refundable deposit should not be a problem.

    It doesn't matter what you think they have done to process your application so far.  It's very likely that the landlord or property manager has already secured credit reports.  Those run about $25 each.

    I can't image a news station interested either.

    The non-refundable fee is just that.   Gone.

    The 100 fee is refundable and depends on if they actually held teh apartment or not.  You did not say how long ago you asked them to hold it.  A month?  A day?    You should get it back, but you need to act reasonable.   Demanding to go into the back office to observe copy making is not reasonable.

    If the time on the application is blank the answer is 0.  0 hours, no grace period.
