Can I get my record expunged?

When I was 17, a boy I hung out with and I broke in to a house(young and dumb). We were later arrested and I was charged with Burgulary 3rd degree (felony) and 2 mistaminers. I was charged as an adult since we were both under age, but I was older and we both had public defenders. I was determined to get out of this trouble my self since I had gotten myself into it. The public defender advised me to plead guilty so I did. Now every one I talk to says I cant get my record expunged because I plead guilty. I was 17 when the offence occured but 18 at the time of trial. I spent time in the military and I an currently in college. I just want my record expunged, what should I do.

  1. First, I would check court records to see if you actually have a record. It MAY have been sealed since you were a minor, even though you were tried as an adult. If you do have a record, you need to petition the court for expungement.


  2. Every state has different standards and procedures.  In my state, for instance, you can get the conviction "sealed" by petitioning the court after a period of years with no convictions.  Unfortunately, it does not apply to every crime.  Notably, those crimes that carry an enhanced sentence for a repeat offense cannot be sealed.  Those include DUI, domestic violence and, in my state, burglary.  It would be worth it to talk to a local criminal lawyer and find out your status.  

  3. I recommend learning how to spell first. Proper English and grammar will go a long way toward making you eligible for just about everything in America.

  4. Talk to the court where you were sentenced. Many state's don't expunge felony convictions.
