Can I have my neighbor arrested?

He was supposed to take my car to a mechanic for me to have the brakes re done. I paid him $900 and all he did was resurface them, not replace. I have witnesses that know he was supposed to replace. Is this too circumstantial, or can he be arrested?

  1. if he used your money for something other than your car then he can be charged with robbery

  3. I hate to disagree with Adam Scott Superville, but this is in no way a robbery. A robbery requires force, or the threat of, to be used in taking of anothers property. If any crime was committed it would be a theft by deceitful means, which is called different things depending on your location.

    If you were to call the police, I can almost guarantee you that they will refer to this as a "civil matter". You entered into an agreement with your neighbor for a service, he failed to provide this service to your satisfaction.

    Your only real option is to sue in small claims court. I really do not no of any police agency that would get involved in this matter as you have described it.

  4. You gave your neighbor 900.00 to take your car in for a brake job. Well the honest answer is you gave it to him willingly. He never stole it. The only violation here is your pride and pocket book. There is nothing you can do legally to recover it from him.

    call the PD and ask them... ask for a real cop not the cadet that answers the phone.

  6. sounds like a civil matter,  that is not really a criminal matter, you can sew the neighbor  and try to get your money back,  but remember you do have to live next to this person, and you have to ask,    how much of an issue do you wan t to make about this,   how much is it worth,   only you can answr that,

  7. Take it to civil court.  Now was it his fault and he pocketed some of the money?  Or did the garage mess up?  You will have to subpoena the garage mechanic so he can make his statement.

  8. 900 to have the brakes redone? into what...gold plating? I take it you're a woman? Why not just take it yourself to a garage next time...fins one you can trust (ask around)..let them do the job and pay them. What's so difficult about that?
