I am looking into hiring my own attorney to help me in my legal battle with my child's father. The state initially started the child support order into effect, but my child's father (lets call him Joe) hired on his own attorney to try and fight the child support order. Joe is now over $1600 due in back child support/current support, and his attorney submitted paperwork on Thursday August 21st, and had a court hearing already scheduled for yesterday, August 25th. I would like to point out that August 25th was also my birthday, and his attorney called to cancel yesterday at 10:30 am to cancel our court hearing, due to car trouble. This is not the first court appearance he has canceled, and I doubt it will be the last. We have another hearing set up in over a month, but my child's father is moving out of state (he has told child support this), and they really aren't doing anything about it. Is it possible that I hire my own attorney to help enforce not only the child support order, but to be reimbursed by Joe or his attorney for gas money, days missed from work, etc, pain and suffering. I do not think yesterday was just a coincidence, why schedule a court date so quickly in the future just to cancel. Plus, he could have had Joe pick him up because he was driving right through his attorney's town from his place, or rent a car. I guess I am tired of being kicked around, and I am tired of the state just letting him go to town. After the 31st of this month he will be 3 months late on back support, and by the time we go to court, he will be $2300 behind. Any help or tips would be appreciated.
