Can I keep my apt. if I pay before midnight on my eviction notice?

I havent been able to pay my rent this month so I got a paper saying to get out before friday.Im just wondering if I pay the whole amount before that day would I be able to stay?

  1. It depends on the laws in your area.  Where we live, I cannot evict a tenant for non-payment of rent.  They have right up until the time on the eviction notice to pay in full.  However, that only works on the 1st time they do it.  If they are consistently late with the rent, then it is considered a material breach of the contract and I can evict them whether they pay in full by the deadline or not.

    Check the rules in your area.  And then get your life in order.  Renters like you make landlords treat other great tenants like c**p because they have been screwed so many times.


  2. First sweet the notice must be thirty day, stay and have and mo or certified check when the Marshall show you good

  3. It is up to the landlord to decide whether or not you can stay.  If they don't accept your rent when presented by Friday, you had best start looking for another place, and FAST.

  4. It depends on what kind of notice he sent - it should be a notice to pay or leave. in which case, YES, you can pay the rent and stay. But keep in mind that you must pay IN FULL or the notice stands.

    Even if you don't pay by Friday he cannot kick you out on that day.  He still has to go thru the eviction process, so you do have a little time to find another place to live that may be cheaper for you.

  5. The landlord may accept the rent and drop the eviction proceedings.  If the landlord accepts the rent and proceeds with the eviction or refuses the rent, the judge will more than likely rule in your favor.
