Can I keep my son from seeing my mother who I believe to be unfit?

  1. She can take you to court so she can visit him if she wanted.  Thats going to cost her a lot of time and money.  If you dont want her to see him, then you can make it happen.  You are the parent not her.  You have the right to decide who can and cant see your son.  But like I said a lot of states have the grandparents right, but it will be a long court process just for her to see him a few hours on the weekends.

  4. There is a law for grandparents which means you can't stop her from seeing your son. Legally anyway.

    But whos to say your not "busy" all the time and your son is with you.

    She can take you to court which is when you would have to prove her unfit.

    Sometimes though grandparents are different with thier grand-kids then with thier own kids.

    It is up to you how to handle it but beware she can take you to court.

    The court will only grant it if they believe it is in the best interest of the child.

    Grandparent Rights to Visitation: Visitation may be granted if the court finds that it is in the best interest of the child for the grandparent to be given visitation, that the grandparent is a fit and proper person to have visitation, that the grandparent has repeatedly attempted to visit the grandchild during the twelve months immediately preceding the filing of the application and was not allowed to visit as a direct result of the actions of either or both of the parents, that there is no other way the grandparent is able to visit the child, and that the grandparent by clear and convincing evidence has successfully rebutted the presumption that the parent's decision to refuse the grandparent visitation was reasonable. Visitation may also be granted if the grandparent's child is deceased or if the child's parents are divorced. G.L.R.I. §15-5-24.1 et seq.

  5. You do not mention specifically why you believe your mother to be unfit to grandparent your child. The answer is yes, you can keep your child away from his grandmother, but make sure you know why you are doing this, because someday, your son will want to know and so will your mother. If this rift is petty and most of them are, settle it, come to terms with mom, and make mom understand that you would like for her to see her grandson, but there are terms that she will have to abide by, or no visitation.

  7. You never stated the reasons as to why you felt she was unfit. If these are real reasons, then start keeping record of things. Should this go to court, you'll have evidence against her.

    In the meantime, lower visitations, or keep visitations to where you must be present. This is your child, and you have more rights than your mother.

    And if your mother goes to court, tell them why you think she is unfit. If you are forced to let your mother see your son, than you should go and supervise the visit.
