Can I lay him off?

I employed a lad to work in my office 3 weeks ago. He just doesn't fit in, is lazy and keeps disappearing for cigarette breaks every half an hour. Can I just tell him its not working out and get rid?

  1. Have a quiet word in his shell like, he may be having more smoke breaks because he is shy and doesnt know how to fit in with the team.

    Give the lad a try, at least he is at work unlike many other lazy scroats.


  2. If he is in his probationary period then yes.  (If his contract states there is one).

    If not then be fair and pull him to one side and address his behaviour and attitude.  Tell him what he is doing wrong.  If he amends his behaviour then fine, if not then out he goes.

  3. Arrange a meeting and discuss this with him.  You have the right to dismiss him during his trial period, but you have to give him a chance.  Consultant your attorney.  Good Luck.

  4. I think, by rights, he is allowed 2 written warnings, a verbal warning, then u can have him dismissed if he doesn't buck his ideas up!

  5. Unless he is employeed in a union postion then you as the employer have the right to fire him at your whim.

    You do not need to give him any warnings etc etc. or even a reason.

    schedule a meeting where you ask him to report on his work progress, let him be the first to criticize what he sees fit

    then, you address all of his issues

    finally you lay claim to your concerns, let him know that there needs to be an effort on his part to belong to the work family

    if this is conducted honestly he will get the picture and either shape up or ship out

  7. what is in the company policy and employment contract he signed about this? You should perhaps warn him (if you haven't so far) first verbally, then in writing if he takes no notice; finally you can serve notice on him. If he has only been with you 3 weeks, this is more or less within  a probationary period, so you might just be able to hand him his P45.

  8. Does he have a contract already? If not then you should be able to.

    Even if he does, there is usually a trial period of 3 months. If it's not working out you can let him go during this time.

    If his contract doesn't have this, then I hope someone with more experience than me answers your question.

    But do put this trial period in all future contracts.

    It is also a good idea to give official warnings. Get the employee to sign the paper so it is recorded. If you have to give more that 3 (?) official warnings it is grounds for dimissal. Do check my facts first.

  9. A guy with such character and attitude will be harmful to your business. You better lay him off as soon as you can. He thinks he is smart and he will never be grateful to you. Show him the  way out.
