Can I legally move to tennessee where i have family even though I'm not divorced. I have two kids with him?

reason for separation is because he constantly cheats on me..little help.

  1. if he agrees and if he does you need it in writing because if he doesn't agree he can place kidnapping charges on you since they are his children too this has happened to my sister trying to leave an abusive husband there is always a loop hole


  2. I don't think you can up and move the kids without his permission.

    I would seek a legal separation and a custody arrangement where you can live out of state with scheduled visitations with the father and you may have to cop to paying half the kids travel fee.

  3. Sorry, you are not allowed to move the children out of state, unless you receive permission from the father of the children or from the family court.

    I suggest, you get it in writing or voice record your husband giving permission, to avoid a messy lawsuit later on.

  4. Probably not. I would not punish my kids by removing them from their father. His cheating should not affect the fact they are able to see him. You should contact a lawyer.
