Can I lose my green card?

My husband and I have been married for 8 months, I have had my green card for for about 3 months. We fight on daily basis and there is a lot of emotional turmoil that I go through with him. We have a six month old son but I can't take it anymore. He is threatening to tell immigration to take my green card since he pertitioned for me to get it. I suspect that he can't do that, but is it possible? I have the two year permanent residency.

  1. He can't do anything.  At the end of the two years you will still be eligible for a permanent green card provided you can demonstrate that you entered the marriage with good intentions.

    I would recommend a marriage counselor.  The main reason for this is to document the turmoil in your marriage and the abuse from your husband.  When you apply for your permanent green card the counselor will be able to submit an affidavit in support of you.

    Don't tell your husband the true purpose of the marriage counselor.  Just get him to go with you.

He certainly can have your green card taken and have you deported if he has reason to believe you "trapped" or "deceived" him into marrying you for the purpose of immigration benefits.  In the case of fraud by you, he can revoke his affidavit of support, and he can get the marriage annulled.  That would get you deported without the child.

    Your child has a right to citizenship in your country of citizenship, so if you would want your child to stay with you, you need to get the child a passport from your country of citizenship.  Otherwise, the child will stay with its US citizen parent.

    His behavior could stem from feeling trapped into a marriage and a child he did not want.  If this is the case, marriage counseling might not prove useful, and it is not grounds for self-sponsorship.  Furthermore, to self-sponsor, you must be self-supporting.

  5. You should go to an immigration lawyer and ask if you could apply for permanent green card without your husband's petition based on VAWA (Violent Against Women Act). You may petition for green card for yourself. Your husband's Mental Torture may be a good ground for your own petition. Good Luck.
