Question:

Can I move out from the house I'm renting without having to worry about anything since my lease expired 01/08?

My lease expired in Jan 2008 and I didn't renew the lease. When I moved in I gave the landlord $400 deposit. I probably would have renewed if he hadn't raised my rent after I told him I would renew, and not only that he said he was going to sell the property. There are rezoning sign put already so meaning he has already signed paperwork and pretty much it is up to the other party if they want to buy. They have already purchased the apt's across the street. So I doubt they will change there mind. I'm planning to move since he said that maybe the demolition would start until Nov or Dec, but who knows and I don't want to wait and see what happens. Do I still need to give him a 30 day notice? Do I still need to pay that last months rent?

  1. yes, a month to month needs to give

    a 30 day notice and pay last month's rent.

    Any refund due will be given to you

    in 15 days.

    MAKE sure you are present for the

    exit walk-through!


  2. Your lease is expired so you are on a month to month lease but you do still have to give him the correct notice - maybe 30 days, but check your lease.  Of course you need to pay the last months rent but he will refund you the security deposit minus any costs for unpaid bills and damages.
