Question:

Can I negotiate with my renter?

After moving out, my renters (westlake village apartments daly city,ca) are asking for an extra 250 or so. There is no way this is true. There was no damage beyond our security deposit and I need a good negotiation method or rights/demands I can make!

  1. Why would the renters be asking for more money?  Do you mean the landlord?  Were you the renter?

If you're the landlord and the renters moved out, and did not have any damage beyond their security deposit, you need to give back what is theirs.

  2. They have to provide you in writing and itemize what exactly  the charges are for.  Keep copies of this letter and write back to them justifying why you do not think you owe this-keep a copy of that as well.  The landlord will need to take you to small claims court to get the money if you do not pay it.  He will need proof & evidence as to the charges.  If you truely did not do any damage, you are not liable.  i would not use them as areference for future housing matters though.  Good luck

  3. But you admit there IS damage(twice) so the next question is how do you know how much it costs to fix that damage?

Materials & labor are not cheap and add up very quickly

  4. You simply ask for a detailed accounting of all the charges. Don't forget a complex will seldom get the cheapest price for repairs. They may be using licensed repairmen who are not cheap.

But you are entitled to a detailed accounting within 14 days.
