Do you have the right to object to a court subpoena if you are afraid for your life?

  1. No. your bound by a judge and cannot over ride that decision.


  2. Yes, you can object all you want but if you fail to show up, you will be in contempt.

  3. If you have a court subpoena, you are in contempt and can be arrested if you do not appear.  If you have a reason for not appearing, you need to get a lawyer as soon as possible to figure out what to do next.

  4. That is not a legal excuse for failing to comply with a subpoena.  My advice is that you get in touch with the prosecutor in the case and inform them of your fear so that you can be protected.

  6. You can object to your heart's content, but you still have to go.  I assume you know what the case is all about, so maybe you should go and talk to the investigating officer about your fears.  Whatever, you still have to go.  Good luck!!

  7. No.  You could ask the prosecutor for protection while the trial is happening.

    Phone the prosecutor and speak about your concerns. They can often offer protection.

    Also, see what your testimony is about. I was subpoenaed once and called the prosecutor and apparently didn't have any of the information they were expecting me to have...I didn't have to go in the end.

  10. Nope. However, I strongly suggest you call the Victim Services Officer at the court that summoned you. The VSO can make arrangements for your own protection, such as a police escort, etc. Call the court and ask them for their VSO's contact information.
