Can I put an offer on a house if I went to an open house without my buyer agent present?

I have a buyers agent and viewed a house without my agent being present. I was asked by the sellers agent to sign a sign in sheet at the open house. My husband and I wanted to see if we could put an offer in on the house. That's when I found out from my agent that I shouldn't have signed the sign in sheet because the seller's agent could demand that my agent split the commission between the both of them.

About a month ago this house came off the market because the listing expired. However, I just noticed this house was just placed on the market again. Is it still possible for me to place an offer on the house using my buyers agent now that the house has been relisted?

  1. Get your Realtor to present any and all offers.  Never make verbal offers....in some states this can become a binding contract.

    They are your agent and know values and can advise you on whether your bid is appropriate


  2. In my area, you could have put an offer in with your buyers agent the first time and your agent would have received the full commission whether you signed in or not.  

    It would get stickier if you had negotiated price or terms verbally or written an offer with the listing agent and then surprised the listing agent with your true Realtor.  

    ***  Buyers....  If you have an agent, ask your agent for "Agent Repellent" also known as a stack of their business cards.  Take them with you when you are looking at Open Houses and hand one to the listing agent when you walk in the door.

    This will keep the listing agent from harassing you and following you around.
