Can I recieve child support from my daughter's father while he is in prison? I live in New Jersey! HELP!

He was recently locked up and is doing time for about 7 more years. My daughter is 3 years old now and never paid me a dime for support for our daughter. Our child support case just began in New Jersey. He just gotten locked up in Philadelphia, can I still receive support for my daughter? Yes-- he was given written proof that he is the father via DNA testing. Any advice?

  2. No, he does not have to pay for the time he is in jail.  The court will require him to give proof of his time that he was incarcerated, when he gets out, and they will document that and not require him to pay for that time period.  If he does not take the proof to them then he will be liable.

  3. Does he have any assets?  A home, cash, a car?

    Is he receiving any income from anyplace?  

    You can't get blood from a stone.

    If he is receiving money or has assets, the judge in your case will be in a position to seize those assets.

  5. Those guys in jail make something like 19 cents an hour, working in jail.  Unless he has a pot of money waiting for him on the outside, there will sadly be very little to collect.

  6. He's Locked up and how going to ask him for money...They only way he can pay child support when get out and have income. Beside you sounds like greedy...
