Can I reclaim 2007 tax? ?

my mom visited us in 2007, I didn't apply tax id for her, so when I asked my accountant to do my tax, I didn't metion it. Now someone told me, if I claim it I could get around $3500, so can I reclaim 2007 tax now?

  1. Please read IRS publication 501 and 519.

    In order to claim your mother as your dependent, you must meet 5 tests.  Visiting you is generally NOT enough.

    1. Related to you (met).

    2. She's a resident alien for US tax purposes (probably not met).  

    3. She's not filing a US MFJ return (met).

    4. Her worldwide income is less than $3400 (probably not met).

    5. Of her total support, you can prove that you paid more than half (probably not met).      


  2. You can file an amended return for 2007 and get a refund if you have one coming.

    BUT - if your mom just visited, and had no tax id, you can't claim her as a dependent.  And even if you could, your savings wouldn't be anywhere NEAR the $3500 you mention.  Depending on your tax bracket, would most likely be $500 or less if you COULD claim her.

  3. need an ITIN for mom to do anything at all

    it's not too late to file an amended 2007 return

    a visit does not necessarily entitle you to take your mother's exemption, so read up on it first

    and if you had no tax liability, you likely won't get anything else;  the $3500 is a subtraction from your gross income to get adjusted gross income, not a payment to you

  4. You can file an amended tax return for 2007 on Form 1040X.  Go to www.irs.gov to download form and instructions.
