Can I record the collection agency on the phone?

Im trying to settle these accounts and theyre being a pain and wont send a letter stating the settlement amount. Could I record the conversation and would that work as proof in case they try to sell the remaining balance or something. I realy want to get these settled but they wont cooperate

You will have to check the law in your state.  You could just call down to your local sheriff's office and ask about recording.  I know that in Missouri, one party is allowed to record without the other party knowing it.  I totally think you should check it out, because I did this exact thing.  I was getting harrassed by a collection company, so I recorded them without them knowing it, and took it to my attorney. His jaw dropped to the floor when he heard how they were treating me.  He called the company and let them know that his client had recorded the call.  Not only did they stop calling me, they forgave the debt, and I never heard from them again.  

    I encourage you to fight back, and give it right back to them.  These companies overstep their boundaries, and they need put in their place! good luck!


  2. Bdancer gave some good advise....Just to add: If this is recent debt within the statute of limitations, you should be careful about telling them that you're tape recording conversations....you might provoke them into more aggressive action like taking you to court.  

  3. Laws vary from state to state, but if you tell them at the start of the call that you are recording the conversation, that should cover it.  Chances are they will hang up on you.

    Have you tried sending them a certified, return receipt letter with the details of your settlement offer?  Ask that an authorized agent sign and return a copy of your letter indicating acceptance of your offer.  Put lines at the bottom for signature, date, and print name.

    Don't talk to them on the phone.  Make a paper trail.
