Can I refuse a third party insurance claim on my policy?

A neighbour claims his car was scratched by my car. My insurance company has now sent a claim form. I intend to refute the claim. Is this possible and what will happen next. Can my insurance company pay out to the third party. Any legal advice is welcomed

  1. Just send a letter to the insurance company disputing there claim, as your neighbour will have to prove it And then letters will go to and through between insurance companies to start with.

  3. You have to report the incident to the insurance company.

    You do NOT have to make a claim on your insurance policy - you can submit the claim form 'for information purposes only' - point out that you will deal with the claim yourself.

    If you do this then your no claims bonus will not be affected (let the insurance company know the result though).

    If you lose then you may not be able to claim indemnity from the insurance company.

  4. Call your insurance company and follow their procedure (and your state procedure).  Tell them about his claim and why he is wrong.

  5. If you didn't scratch the car do not fill in the form.

    Send it back to your insurer with a covering letter saying that you have no knowledge of the alleged incident.
