Can I remove my furniture out from the apartment if tenant doesn't pay rent?

The question is we have signed the rental agreement before the guy moved in. Since he doesn't pay the rent, he already break the contract. Why shoud I continue supply furniture to him without rent? Yes, it is rented as furnish and it is written in the contract, the rent covers the furniture and housing. However, he doesn't pay the rent, what point to cover the furniture and housing?

Can't I give him 24 hours notice and get back my stuff?

  1. No, you can't remove it.  If he is not paying rent, you have to evict him.  Serve all the proper notices and go to court.


  2. No, of course you can not touch anything inside his home.

    This is his home until he is evicted, he can actually have you arrested for stealing, because you have no right to the furniture at this point in time.

    If you want the judge to sign the eviction I suggest you refrain from stupid and aggressive acts.

    Unfortunately, he has the right to full use of the furniture until a court evicts him.

    If you enter to remove the furniture you are setting yourself up for a lawsuit for an illegal eviction, trespassing, unlawful entry ...

    to give him 10 days to return.

    If it has not been, you must get legal judgments to get him out.
