Can I report my childs car seat stolen if her father took it out of my vehicle and won't give it back to me?

I was in a car accident and was transported to the hospital. I called my ex boyfriend to come and pick up our daughter because she was not injured. He took the car seat out of my vehicle and put it in his and now...a week later he won't return it. I've been asking him for it back and he won't give it back at all. Can I file a police report that he stole the car seat? I hav ethe receipt for the car seat too....

  1. This is a difficult one, as the ex had to use the child seat restraint to provide an element of safety for your child whilst he transported her to safety after your accident. He could say that you are not fit enough to drive and he needs the car seat for the safety of the child, Police may say it is a domestic matter, and the only avenue you have for recourse is to file a civil claim against him for the revovery of the cost of the child seat in a small claims dispute.

  3. No.  But you can file charges of child endangerment against him.  Go talk to the police and see what they think.  

    He can always say "Oh! I just keep forgetting it.." But his not providing the seat endangers the welfare of the child when she has to have it in any vehicle.

  4. I believe that, since you are not married, that car seat DOES belongs to you.  If you have the receipt, you have proof and I'd warn him first before going to the police.  Good luck.

  5. You are aware that after a child seat has been involved in a car accident it should be replaced.

    Or if  you would rather not replace the seat - you can look at it this way - if he did not have a child seat and will possibly be riding the child around in his vehicle - don't you feel better knowing that he now has a child seat in the car to use.

    I'd just replace it and be done with it.

  8. He stole it from you basically i would go to your local police station tell them wat happened and ask them wat to do if they tell you to report it do and if they don't i guess your on your own

  9. if you have the receipt and you paid for it, then its like anything else, yes you can sue him for it, but is it really worth it?

  10. It sounds like you have other issues to deal with. Your EX needs to be aware that it is in the child's best interest to be secured in a proper restraint device per the law. If indeed he will not return the seat for your use, contact the police. Your child deserves to be protected.
