Question:

Can I request in writing that someone else pick up my last paycheck?

My former employer is the devil. I quit on Friday and my final check is due this Friday. My question is - can I have my boyfriend bring the check home with him (he works there and it is commom knowledge that we are dating) if I send him with a letter requesting that my check be given to him? Or do I have to pick it up myself? What if they say they sent it? I don't want to go in and get my check because they are disgusting people and I don't want to say anything that could get my boyfriend in trouble (like I hope you rot in h**l, I hope you suffer a slow painful death, blah blah blah). What do I do in this case? Also, I knew I was going to be quitting so I took my two weeks vacation pay. Can they withhold my last paycheck to pay back my vacation pay? We don't have an employee manual (because the devil owner doesn't believe in them - wants to change policies as he sees fit) and there was never any policy on vacation pay. I live in Wisconsin if that helps with the answer. I know the laws are different in each state.

  1. Company policy (written or unwritten) dictates procedure.

Best advice I would give you, is just go in when you normally would be paid and ask for your check.

    Why?

You are protected by state and federal law (unless you are a "1099 employee"), and this would establish the fact that the employer withheld your pay.

The odds are you will be paid. Try to calculate what is due you and if its close I would call it even. Just check the amount before you leave. If there is a problem, then ask about it.

    You will be fine.

    Good luck.

  2. Some employers will allow you to do this, but you would probably have to call & request it. They would want to make sure that your boyfriend did not write the note himself.

  3. Most businesses are not that equip with basic H.R. knowledge so just go ahead and write a letter by hand requesting that they release your check to your boyfriend and that you will not hold the company accountable if it is lost or stolen.
