Can I request my father's POA from the court house? Is it public record?

  1. A durable power of attorney is almost never a public record, or even in the courthouse.  A POA would ONLY be part of the court record if there has been a legal proceeding where it is an issue.  For example, if there was a proceeding to have your father declared incompetent, the POA might be there.  Otherwise, it is a private document (like a will), that is not filed unless theere is a legal proceeding.

    Remember, POAs can be changed at almost any time, so to file the document with the courthouse would result in HUGE file space requirements, due to the many changes.  In addition, it could result in an "old" power of attorney being relied upon by someone, when it has already been replaced.

    It is not clear why you are asking, so I am not sure how I can better answer the question.

    Why don't you just try to check it out...and find it or not you will know from the search results. You can try to search online for government records, court records or civil records, etc. Good Luck.
