Can I sell my husband's car if I am not on the title?

He bought the car a couple months ago. He still owes the guy $500 for it and the man wants his money or the car back. My husband is gone and I have the car.

  1. 1. you cannot sell a car that is not yours.

    2. if your husband has title, the man cannot take the car back.  that would be stealing, unless he had a lien on the vehicle.

    3. Tell him he need to find your husband and sue him.  If he takes the car, you will report the car as stolen.

  2. no you cant because if you sell the car you need to put the under the buyers name and to do that you the owner of the car needs to sign and you are not the owner because you are not in the title

Legally you cannot sell the car if your name is not on the title because you would be unable to transfer the title to someone else unless you are able to negotiate something with your local Department of Motor Vehicle Service or whichever state agency handles titles.  If your husband is incapacitated, then you should be able to do business on his behalf.  Another thing to consider is whether the car was bought before or after you and husband married.  If it was before marriage, then it may be a little trickier than him purchasing it after you all married.  Refer to this link for further details: http://www.wisegeek.com/what-is-an-auto-...

  7. No, as if your name isn't on the title, it isn't "your" car.  You can't sell something you don't own.  If you do, its called fraud, and could land you in jail.

  8. No, you can't sell your husband's car because it isn't yours to sell, your name is not on the title along with his with an "OR" between your names.  

    Your husband can't sell it either, since he still owes $500 on it without paying it off first and getting a clear title.

  10. K. If your husband owes money on the car, he doesn't have the title. The lender has the title and therefore can come get the car whenever the loan is in default. Give him the car.

    IF your husband has the title cause someone loaned him the entire cost of the vehicle and your husband got the title in his name but owed the lender the money, just let the lender take the car and deal with getting the title in his name. It really isn't YOUR problem. And NO, you can't sell the car.
