Can I still apply for British citizenship if I am separated from my married partner?

I am married to a British but unfortunately it didn’t go well so he chose to end the relationship. He stays married to me so that I can apply for the British Citizenship. Now I can apply for British Natualisation but I am wondering if I am still eligible to do so. We have been separated from each other and living in different houses for over 1 year now after I was granted my ‘Leave to Remain’. Will that be a problem if I apply? Please if anyone knows the answer to this, help me. Thank you very much.

  1. Based on your question it does appear there is an issue of fraud and it could lead to a denial of your application. Even if fraud is not the case it does call into question your character and if your character is questionable it could lead to a denial based on character.

    At least from my understanding if you have been granted permanent residency if the marriage failed then you should still have a right to remain in the UK. However since you remained married in order to get British Citizenship that may hurt your chances. My recommendation before you take the Life in Britain test is to contact an immigration solicitor for guidance.


  2. If you meet all the requirements now set out yes, however I would strongly suggest you go and see a solicitor in your area, you can not really say you are 'married' in your application as you are separated and have been or over a year.
