Can I still get maintenance for my physically disabled son now he is 16 years old?

Now that my son has just left school and he is 16 years old. Also he is not going into full or part time education and has no job to go to yet! Can I still get maintenance from his farther until he is 18?

    By reading this, it sounds like you are trying to gain a maximum sum of money out of the father. Do you Really need the money, does it go to your son, and could you afford to keep him without the father's support.

    A person is classed as an adult at 16

    A person is classed as an adult at 18

    The goverment never makes anything clear.

    If his Dad offers the money, I wouldn't turn it down.

  2. Legally I doubt it if he isn't going on to full time education but his Dad may agree voluntarily to continue payment to you.

    On top of this he may be entitled to benefits in his own right once he has left school - usually Incapacity Benefit, Severe Disablement allowance to make up £84.40 a week plus DLA at either the lower £17.45 or higher £45.75 rate.

    His benefits may be lowered if he you are still getting maintainence - so he won't be any better off.
