Can I still stay in the United Kingdom after a divorce?

I have lived in the UK for 5 years - I came over on a marriage visa and got married 4 1/2 years ago. I was given permission to stay in the country permanantly after our wedding took place. My British husband now wants a divorce. Am I still entitled to stay in the country if I am not married to a British citizen? I have an American passport - not a British one.

  1. If you have your indefinite visa to remain in the country--yes you can stay here in the UK..had lots of friends who's got the same situation like you,,,and they applied for their British citizenship and has been granted..

  2. If you are given permission to stay permanently, that means exactly that. Also, if you've been living in the UK for five years (or three years if you are married to a British citizen) you can apply for naturalisation as a British citizen.

    That said, it doesn't really offer any huge benefits and I don't think America likes its citizens being duel nationality...

  5. As far as I an aware, yes, the ruling is two years of marriage as in the sense that you were both living together as man and wife. You may have to prove this by way of council tax bill or some bill in your name, along with bills in your husbands name, (of the same address for the period) It is always best to check these things out first of all with the US embassy in London, as rules do change from time to time, though having said that, the embassy would have to stick to the rules that were in force at the time that you applied for a marriage visa. If you've still got that document, it should state on it the rules. I know of some foreign nationals who get their passports stamped 'Indefinate leave to remain' after being married so long, 2 or 3 years.
