Can I sue Dell in a PA small claims court if i purchased the computers over the internet?

I purchased 5 laptops for my business at a great price, $400 each. The order was delayed for a month, I received numerous emails regarding the delays. The last email asked me to "consent" to an additional delay, which i did 10 minutes after receiving the email. The next day dell cancelled my order, the reason per the email response from dell was I did not "consent" to the additional delay, which is false, I have proof via email the consent was sent and delivered. I called Dell to reinstate the order, but I was told the PRICE WAS TOO LOW, IT WAS A PRICE MISTAKE, THE NEW PRICE FOR THE SAME COMPUTERS WOULD BE DOUBLE. I know for a fact other people had computers shipped at the same price I paid, the price was not unreasonable, just a great deal, 50% off in this recessionary environment is not that unusual. Can i sue dell in a PA small claims court for the difference in price between the initial order and what dell wants to charge me today? Thanks

  1. of course 50% off computers is unusual - it's non-existant - there is no way Dell makes 50% profit on their computers

Although the laws for a small claims suit can be different state to state, the short answer to your question would be 'yes', you can file a claim against anyone.  Winning, however, is another thing altogether.  I would highly suggest continuing trying to force Dell into complying with their offer, and I would do it over the phone and in writing, going to the highest level of support needed.  It's gonna be hard to beat a company like Dell in court as they'll be very thorough in their 'user agreement' .  I guess the bottom line is this, if everything fails, is your time and fees (if you retain a lawyer) worth it?
