Can I sue a restaurant for finding what looks like a rat bone in my food?

I ordered out... When I got home, I found a strange bone in my food. I have called the Department of Health and told them what I found so they can go to the restaurant and investigate. I am almost certain it is a rat, or some kind or rodents arm, or leg. I am in the process of finding out exactly who/what the bone belongs to but what I would like to know is, If it really is a rat bone or something odd like that, Can I sue the restaurant and have a great chance of winning???

  1. If that happened, you should call and inform the restaurant manager right away. If you didn't, your case will be weaker. Also, the D of H can do tests to see where this bone came from, and if in fact it was found in your food or planted. Remember that lady who found a finger in her chili from Wendy's and then sued? After an extensive search was performed, it was determined that none of the workers had lost a finger, and it was later found out she planted it. She was charged and convicted. I'm not saying you planted this "rat bone" but the restaurant, especially if it is a chain, is going to do extensive searching to find out how a single "rat bone" got into your food, and why didn't the rest of the rat, and etc. What did you order? Is it something that could have bones in it?


  2. As long as you didnt order anything with a possibility of a bone in it. Does the Department of Health want it? It should be tested, either way. I think you could sue. That is disguisting!

  4. Did you complain to the restaurant manager in person or by phone?  If not, your case is weaker.  .

    You can sue if you were injured or incurred damage by the event.  If you got sick over it then you may have a case.  

    You didn't mention what the dish was or anything so we cannot tell if it is something that might have legitimately been there.  Chances are your health department can tell you what the bone belongs to and might even want it.
