Can I sue my employer for firing me when I come late to work and write down wrong hours?

I come to work at 6:30am, I wrote down 6:00am starting time in the time cards. I was terminated and then I called in to quit job. Can I sue my employer?

  1. Anyone can sue anyone any time, if an attorney would take your case. However you are not likely to win as it was falsification of a document.  I assume that the actual starting time was to have been 6 am.  No jury is going to believe you just forgot you were a half hour late.  You'd be wasting your money.  You are not likely to get unemployment either since it was justifiable termination.  If they let  you have it, you'll be very lucky.  Even if you had a union, they are unlikely to get you off on that one, even with suspension and even if it was the first offense.  Might possibly be able to do arbitration and get you a suspension if you do have a union, but very iffy.  However if you have a union, contact the union steward just in case they can take this one up.  But chances are still slim.  If you don't have a union, I'd not put bet on your side.

    Don't put falsifications on documents.  You could have been fired for being late, but probably would not have been if you had any kind of excuse and it was not chronic.  That could help in the future.  You might check with the company and see if they will rescind the termination if you resign in writing.  They may not but it might be worth it to try to get the negative off your employee records. And if  you do that, put for personal reasons or something similar and be prepared to explain to the next employer.

  6. You can sue anybody at any time for any reason you want.  Will you prevail. NO!  If I were your employer I'd prosecute you for fraud and theft.

    I gotta hand it to you though.  It takes a complete lack of moral character to want to sue someone because they caught you lying, cheating and stealing.  Your mom must be so proud.
