Question:

Can I sue physical therapist for negligence

after my total hip repair surgery, the physical therapist was supposed to educate me on total hip precautions but she ended up not following one herself and put me at risk. Luckily I'm fine, but she was still negligent and could have dislocated my hip. Can I sue her?

  1. While it was certainly negligent, since no injury occurred, no suit can follow.  For negligence, it has to be proven that the act did (or didn't occur) and that injury and/or financial loss occurred.

  2. You could speak to the national medical board and get a reprimand to her. But, unless there was a injury you cannot sue.
