Can I sue that hair salon for injury???

Hi,

I went to a hair salon to do hair strengthening. After they had done my hair my head felt like a burning sensation and hurt. Right now, every time I shampoo I will feel extremely hurtful like you are using a needle to pin in my head. I believe they are using too much chemical cream or illegal cream I don't know...my neck and some area on my face are left with red marks due to burning. I hate this very much. My hair lost shininess, firmness, and I experience hair loss too.

Can I sue them for "Duty NOT to warn"?? or just negligence or punitive damage?? What best reasons can I sue them because I'm very fraustrated right now. Can I win or not?

  2. I would go to the salon and explain what had happened.  

    I think that failure to warn would be a stretch, because they cannot know how each individual will react to a product.  I, for example, react badly to the type of hair color the salon I visit uses, however my sister is just fine with it.   It's highly individual, however, upon seeing that you were having a bad reaction, they should have attempted to remedy the situation -- if they are not aware, let them know.

    I bet they will want to correct the error, since salons can quickly get a bad reputation -- they don't want a result like yours to be seen as the norm for their salon, so they will want to correct it for you.

    wanting your hair back to its original condition is a tall order though -- any time you use a chemical treatment on your hair, you are altering its condition, and you willingly entered in to that by the request, and even if all went right, your hair condition would not be the 'same' -- I'd work on the wording there, because they cannot get it to be the 'same' -- you can point out what is not working for you (ie: hair loss) and they can address that, but no one can 'make it the same' -- it might make it easier for them to help you if you give them realistic goals to work towards

  3. sounds like you had an allergic reaction to the chemicals they put in your hair.

    you should do the following:

    notify the manager of the salon about what happened and find out the name of the product used.  you should talk to other stylists about this product and how it is supposed to be used.   in order to sue for negligence, you have to prove the salon did something wrong.  it's not enough for you to have a reaction, but you have to prove the reaction you had is their fault.

    once you are armed with some knowledge about the product, then

    you can hire a personal injury attorney who will handle you case on a contingency fee agreement.  that means you pay nothing unless you win.

  5. do you have $300 an hour to pay a lawyer?  If not, go to the salon, show and tell them what is going on.  Good chance they will offer your money back, some free future services and perhaps some free products.  You may be having an allergic reaction or are more sensitive than most.  If they used too much chemical, they need to know about it to spare the next person the same misery,  Hope you feel better soon.

  7. I would go for it.  Sue them for all those reasons.

  8. Pouring toxic chemicals on your head can make your head hurt.  In law it's called assumed risk.  It's more commonly known as common sense.

  9. Did you at the very least talk to them and see if they would be willing to right the wrongs for you without immediately jumping to the "im going to sue you" part?

    If you're going to sue then you're going to have to prove in some way they were criminally negligent. you'll need proof of some sort.

    But the thing is you assumed the risk. Straightening your hair uses some pretty abraisive chemicals, and you get the treatment under the assumption that the chemicals are dangerous and there is risk of injury or side effect. It's also possible that what they did was correct, and it was you that was too sensitive to the product they used, and that would not be their fault because itd be impossible for them to know.

    Talk to them first, and see what they'll do for you. You will typically wind up much better off settling than suing and getting less in awards.

    If it's a big chain, you can just get them fired

    Small business you can really do some damage, and put them out of business if you really try hard
