Question:

Can I sue the Attorney General of Texas?

The AG of Texas is sueing me for child support. My ex lied in order to receive benifits on three of our children(worked under the table and didn't report income). Our divorce decree does not have child support for either of us to pay-He cares for the three children and I care for one. I am being sued because he has been lying. I want to counter-sue.

  1. This is a civil suit, you need to get your attorney to revise your settlement, the A.G. didn't  make the decision the court did.

  2. Personally, over something done as a holder of the office? NO.

Officially, over some act as AG?  Possibly, although most government departments are immune from a lot of lawsuits.

Personally, over persoanl acts, not related to the office? Sure.

Really, you haven't given any information needed to supply a meaningful answer.

  3. Nope. "I am being sued because he has been lying. I want to counter-sue." - Fine, but the AG is not the right person to sue, your ex is.

  4. If you want to counter-sue, then counter-sue.

Divorce decrees, as well as child support and custody orders, can be modified, based on changes in circumstances.

The way you worded your question tells me that you have not yet consulted your attorney.  And you are considering suing the Attorney General of Texas?  Think about it for a little while.  They have all the necessary attorney resources and you have none.  They will know how to block actions that you have not done correctly.  What are the chances that you will not handle a legal procedure correctly?

If you do not have an attorney, use the lawyer referral services of the State Bar of Texas: www.texasbar.com .

  5. *Yes*

  6. i think u can...but it has to go to federal court
