Can I sue the Lactaid milk company?

A couple of weeks ago my mother bought the Lactaid milk and when i tried to eat it with my cereal my cereal tasted awful, bitter and just disgusting. (the milk exp. date was aug 15 so at that time was a few weeks away). Anyway I threw the milk out. But last week my mother bought me another carton of Lactaid milk its exp. date also aug 15. Anyway when i put it in my cereal. (different cereal than before). it again tasted very awful. I wasn't really sure what was wrong so i put the milk back in the fridge. Today i took it out to check it out if it was useable and when i poured some out into the sink yellowish type of water came out. when i opened up the carton all the way the milk looked like sour cream/yogurt. Both cartons of milk weren't supposed to expire for weeks. So my question is it possible to sue the company for distributing it? Should there be any health concerns for me?

  1. if you want rather than spending tones of money on a lawyer, call the company ( probably the phone number on the carton) and explain to them what happened, the same thing happened to my aunt and the company sent her a whole bunch of coupons . as for health , dont worry about it, if you  get sick (nausia, heartburn,indigestion, upset stomach or direrhia) take some pepto and rest, if that doesnt work go to the doctor.


  2. I'm not sure if you would have a case. Contacting the company would be best, and don't throw away the milk. Take it back to the store and exchange it for Lactaid with a different expiration date. Might have been a bad batch, or wasn't cooled properly during transport to the store.

  3. They may not even know.  I would call the company (or e-mail them), and explain what happened.  Most companies are very happy to replace the product for free/give coupons.  Just make sure to have the store where purchased, and possibly the carton from the last milk you bought.  That way they can find out which batch it came from, and get it off the shelves.
