Can I sue the court for negligence resulting in arrest?

A year or so ago, I had a DUI, and was issued a court date. I did not miss the hearing, and attended everything I was meant to, and got my stuff out of the way. A while later, I was arrested because the cop said I had a "bench warrant" against me, and I said that cant be right. They arrested me anyway, and I ended up spending 24 hours or so in jail, combined with being made to look like an idiot in front of a bunch of friends. I was informed that I would not be let out until I saw the judge, on monday, and I was arrested on thursday afternoon, wasnt booked until friday morning. I made a call out to my dad, he went to the court and asked them why the h**l i got arrested, and they said it was a mistake, and the judge signed an immediate order for my release, and i was out in another 4 hours or so. What i want to know is, can I sue the court for negligence? They forgot to either dismiss the bench warrant, or file the paper that said I had been to my hearing.

  1. you can not sue the Court or the prosecutor. you can easily sue the person who tack you to the Court. or the town or the cop.you pout in jell by mistake, you can easily the tow who first tack you in the court, and you will win, they will saddle the Case ,.you Ned to get a lawyer .easy 2000.00 dollars plus the lawyer will get 33%

First, disregard everything the moron who said you can sue the cop has to say -- he has no idea what he's talking about.  There is a federal law that shields government agents from liability, unless their action was malicious or intentional (a mistake doesn't count).  Second, you really would need more info to determine if you have ANY case against the arresting agency.  If they were acting in good faith, based on erroneous NCIC data, you're out of luck.  If the arresting officer was just a total moron, and had NO basis for the arrest, you probably have a case.  Don't expect much though.

  5. Unfortunately, I've been arrested plenty of times in my life, and this has actually happened to me here in Macomb, Michigan. You can definitely sue, because I am in the process of my lawsuit. Will you win? Yes probably, but don't go asking for millions. You only spent one night in jail. The most they'll do is compensate you for work, and give you some money for pain and suffering. Either way man, sue the h**l out of them, s***w those a******s. Good luck.

  7. I would definitely talk to a lawyer. This has happened to a lot of people so I'm sure they would be familiar with it. To me that is undue mental anguish and makes you look bad etc. I hope everything works out :D

  8. You should be able to sue.  They were negligent and as a result of that you were made to suffer.  But you'd need to talk to a lawyer, this isn't something you should attempt on your own.
