Can I sue the manufacturer of this product?

I work with heavy machinery and I got hit in the head by a part that shot off of a truck. There was another guy that was killed from the same exact thing. The fault was from a design problem and not a problem from usage. I found out that there was a recall on the product 2 years ago before i got hit, but we just got the notice 2 days ago after i was hit. Do i have a case against the manufacturer or are they safe because of the recall that we recieved too late?

  1. yes you can sue. It will be easy to find a lawyer to represent you. The blunt reality, though, is that unless you were hurt badly, you won't get much IF you do win.

    It does not make sense that the recall was 2 yrs ago and the notice was received recently.


  2. Talk to a lawyer.  If the product was recalled two years ago, and your company was still using it, it sounds like a company liability issue, not a manufacturer liability.  (retired IBM exec mgr)

  3. It all depends. I would talk to a lawyer about it. If you hadn't been informed then someone, employer or mfgr. should have some liability. I think you should get all the information you can and talk to a lawyer.

    If the company is based in another country it makes it harder to peruse, but not impossible.

  4. Well if its not from China you can surely sue them
