Can I sue the parents or the minor (17 year old) who caused injury auto accident.?

I was hit by a a 17 year old driving a stolen car. I was injured and my car was totaled. My medical and auto insurance companies paid my bills but I want to sue the kid that hit me. His parents have tons of money and seem to let him do whatever he wants. He lives at home and has no job, no drivers license and no insurance. He was allowed to attend teen court and all charges against him were dismissed.

I have permanent pain and scars and he is off free.

What can I do??

  3. You can sue anyone. Can you win is another story. I believe that you can sue the parents if its not an accident, meaning they are negligent for the minor's behavior

  5. If I am not mistaken, I believe you have to sue both him and his parents. If you only sue him he gets off because he is a minor. If you only sue his parents, he doesn't get to be there. It will all happen in the same trial, but because minors aren't legally responsible for their actions, especially financially, you have to go for both. Consult an attorney, they will know what to do.

The perpetrator is a minor, thus not responsible for his actions...His parents are...Take them for all you can get...And do it NOW!!...Get an attorney that works on a contingency fee (they get about 33% of the settlement)...Make sure that you have all police reports, medical records and photos of your vehicle and where the mishap occured, witness statements - everything - by the time you have to go to court...I wish I could sit in on your jury

  7. let the parents do the discipline - if he really is as bad as you say he will have a terrible life, you don't have to make it worse..... also, there might be something there that you don't know about or are missing that is going on with the family, maybe the parents did a bad job raising him but there also might be some underlying issues that are causing the behavior, a badly behaved child can really ruin a family and a lawsuit from you trying to teach a kid a lesson can really put some added pressure on the situation (I am speaking from experience this happened to my out of control sister)

    I understand you are probably going through a lot of pain and heartache and you definitely deserved the settlement from the insurance companies, but don't purposely go after this kid just to teach him a lesson, its not your place... move on with your life and be happy, not vengeful
