Can I sue them for the run around?

T-mobile has given me every excuse in the book on why I haven't received my rebate. From wrong imei number to "your # is already been used for a rebate". In other words, submitted every excuse on why the rebate can't be sent to me. Now they admitted two months ago its their computer that's the problem and not me, but still no rebate.

  1. This is America.  You can sue anybody at any time for any reason or no reason at all.  By all means tie up the judicial system over a couple hundred dollars.


  2. Be persistent rather than sue-minded.

    Take an afternoon (or morning, or night, whatever is best in your schedule) when you know you wont have to do anything for about 2 hours and get on the phone with TMobile.  

    Rather than just speaking with the CSR that takes your call, immediately ask to speak with a supervisor.  The "supervisors" have much more authority, and are there for the simple purposes of making the customer happy and keeping a good reputation for the company.

    Do not get off the phone until you can pin the supervisor down to an approximate time window in which you should get your rebate.  If they insist a computer issue is preventing them from sending a rebate to you, request that they just give you a free month of service, or something comparable like that.  Of course, these are solutions they should be thinking up on their own, but you never know.

    Again, persistance is key.  No matter how frustrated you are, speak kindly and keep your cool.  Explain how you've been given the run-around for months now, and you just want your rebate.  Do *not* mention that you want to "sue" them, because that just makes you sound petty and unreasonable.

    Plus, on top of that, it will end up being longer before you get the rebate back since once you mention the word "sue" you have to go through a bunch of red tape on their end.  The person you're speaking with on the phone doesn't care if you sue the company, so just try to stay calm with them and don't let them off without you getting at least a deadline on when you should receive your rebate.

    Again, supervisor, supervisor, supervisor.  If they, for some crazy reason, have an issue helping you: ask for their supervisor.

If you had a contract specifying the date for the rebate, then you have a claim.  If not, then they aren't late yet.  BTW, expect to spend at least a couple hundreds bucks and perhaps many thousands of dollars trying to sue. And, if you lose because you didn't know how to sue properly, they never have to send the rebate to you.

  8. No you can't sue for a rebate. You could only sue to make them take back the phone and cancel the contract you purchased on account of a rebate. You could also contact your local consumer affairs Govt office and complain.
