Can I sue this man, how much would I be getting out of it.

I was involved in a car accident (not my fault) a driver hit my car in the back, totaling my whole car. (impact from back was about 55MPH). I had a neck injury from this went to the hospital and got x-rays.

Can I sue this driver? And about how much do I get?

  1. get a lawyer and they will be able to tell you if you have a case. trying to do it your self to save some money isn't very bright.


  2. That sucks! Hopefully, you're not seriously injured. Whether or not you can collect money depends on if you live in a no-fault state or if the driver was at fault (if you do live in a state that determines fault). Check the yellow pages for "sleazy lawyers" section to find someone willing to take on the case.

  3. Sure you can sue the driver.  You could even sue the maker of the car, and the company that provided the gas.  In the United States you can sue anybody.  Whether or not you will win is something different entirely.

    Even if you were to win a lawsuit against this guy, what are the odds that this person will be able to pay?  Your best bet is to pursue a claim through your own insurance company.  Use your uninsured / underinsured motorist part of your coverage and have your own insurance company pay for your medical bills.  Your insurance company then would sue the other driver for you.

    However, should you decide to sue, you will be only entitled to what was not covered by your insurance company, your medical bills and lost wages.  You will not get money for pain and suffering, or receive some sort of huge payment.

  4. You'll get what you deserve, if you get a good attorney.  Attorneys get maximum 33 and a third percent.  To many factors to list, regarding how much.  The thing is, never plan on the money, the more of a hurry you are in, the less you will get.  It could take six months, or a year, or even a few years. Hire an attorney.
