Okay I have a problem we just moved to a friends house and me and my boyfriend have 2 dogs we put 2 dog houses in an empty lot for sale behind the house. So heres the problem like 3 days ago sometime at night someone let my b.fs dog of his chain and took the collor. We eoke up to find him on the porch. So we thought it was the kids in the neighbor hood. the next day he was unscrewed from his chain so we thought about it and we figure a kid wouldnt risk being caught in the brightness of day so we were clue less. Then this morning i found my dog attached to my b.fs dogs chain.... we already have a person who we think did it. So my question is if we have a video of whoever is doing this can he/she be taken to court??? because i do not want my dog messed with or able to run away... so please what can i do, or what can be done.... he seems to do this at night, we already put up a sensor light.....

  1. Why not put your doghouses on your own property?

  2. What you can do is stop leaving your dogs outside, unattended. Problem solved It's a very bad idea to do that.  Some stray animal could come and kill your dog.

  3. Probably couldnt sue since you put them on a empty thats not yours you can get in troble for that he can get troble for lettign them lose you both would probably go to jail take them of the empty lot and put them on the yard were your staying then you could sue him if its on your yard and he would just go to jail its illegal for your dog to usa a yard that belongs to someone else

  4. There is a possibility that the person that is doing this is the property owner.  I understand that the lot is empty and for sale.  However, you have no legal right to place anything in or on the property.  Therefore, I would move your dogs and houses back onto your property.  Leaving your furry family members in a vacant lot can get them confiscated by Animal Control.

Now if your pooches were on your property and they were being messed with, you can get the person for trespass to land.  Any injuries to the dogs, they can be held accountable.  Videos are nice to have and can be used at trial.  But your dogs have to be on your property.

    EDIT:

I understand that your dogs dig in your yard.  That is your training issue not anyone elses.  The defense that "other people do it" does not excuse your illegal use of the property.  Move your dogs back onto your own property and you will have a case.  Until then you will not have a leg to stand on in court.  It would be no different then if one of your neighbors took their dog houses, placed them in your yard and allowed their dogs to dig in your yard because they don't want their yard torn up.

Train your dogs to stop digging.  Move all your dogs and houses back on your property and you will have nothing to worry about.  Your trespassing on someone else's land.

  5. .   The charge would be "Criminal Mischief" for the dog releaser.  But the dogs are on someone else's property so you aren't protected very well by the law.  You would need to take reasonable steps to protect the dogs after you were on notice that they are not safe in the lot.

  6. put the dogs on the property you live on & put up no trespassing signs

because if they are not on the property you live on, you have no rights.by law.

  7. Yeah, it can. For trespass and messing with your friend's property. You could just confront the person, too. He/She probably doesn't want to get in trouble.
