Can I withdrawn Greencard sponsership after 7 years of marriage?

I married somone who was an H1-B and sponsered him for his greencard-he did have his adjustment of status removed in 2006 and has a greencard for that expires in 10 years (something like that). Anyways- He is very abusive refuses to work (for 3 years now) tells me we are going to divorce in december (dunno what the dec mark means).

I want to divorce NOW but he threathens me that I will never see my chilld again when he leaves....(the child does NOT have an passport)...

Any suggestions or advice would be great!!!

  2. No, after two years of marriage the greencard is his to keep.

  3. He's not going anywhere.  He's here to stay.  Your affidavit of support will continue to live on too.  That's good until he becomes a US citizen or works for 10 years.

    You need a good family law attorney.  You need to get supervised visits only between him and the kids.

    He can get them passports from his own country and get them out of the country that way.

    Don't wait until December, put him out on the street ASAP.

  5. You can divorce him, but he's here to stay, if he wants to. Although your child may not have an American passport, and can't get one without your signature, that doesn't mean he couldn't get the child a passport from his country and take the child back home that way, or for that matter fake your signature. Unfortunately, it happens all the time. Take a look at travel.state.gov and look through the Children's Issues section. There's a great deal of very good information there on this subject. If you do divorce, you need a court order giving you sole custody or it will be very difficult to stop him taking your child even if you are aware of it and try to stop. You need to take this very seriously.
