Can Medicare come after me for the money my grandmother gave me? If the nursing home have no other family member to be appointed as a guardenship. Will they get some one out side of the family? There is no property or money so what is there to guard over? I know my grandmother was tied of my first cousin and my sister getting into it all the time about money. Per her request she instructed me to sell and take the monies. My question is? Will Medicare try to come after me to make me return monies or pay for this bill? They ruled her incomptent and trying to say at the time she asigned me power of attorney he may not have been in her right mind. I know my grandmother and she was in her right mind. The nursing home doctor ruled her that to keep her from signing any future papers between the family members. So what happens next?

  1. My advice to you would be to seek the advice of a qualified attorney. Yes,medicare can come after you especially if they think there was any type of medicare fraud involved. Your grandmothers house was probably listed as an asset for medicare purposes and therefore when it was sold the money from the sale should have been applied to her nursing home bill. It probably says that somewhere in the agreement that was signed when she entered the nursing home. Depending also on your grandmothers will,you may also owe some of your family members money from the sale of the house if there was any left after her medical bills were paid. You may have gotten yourself into a serious situation without realizing it. Please contact an attorney.
