Can My school legally take away a cell phone for 5 days?

My school recently implemented a new policy on cell phone usage. First offense that you are caught with it in class you get a detention and it is confiscated until the end of the day. Second offense you get more or less a longer detention and it is confiscated and your parent is forced to come pick it up. Third offense it is confiscated for five days, but I am not sure of the other punishment that goes with the third offense. I know the first two are completely legal, but I was wondering about the third offense' legality.

I swear to Jesus, if I get mine tooken away for 1 week (my school also kisses a*s), Im going to call my dad, his biker gang, and all the other mean f**k people my dad knows, (he hangs out with biker gangs) and have them get it back with force! XD

URGH TODAY MY FRIEND DROPPED HER IPOD OUT OF HER POCKET( SHE WASN'T USING IT) AND THE FAT SUPERVISOR CAME UP STARTED SCREAMING AT HER, AND MADE HER GO SIT IN THE PRINCIPLES OFFICE, WELL THE SUPERVISER TOLD THE PRINCIPLE SOME UNTRUE STORY THAT NEVER HAPPENED, AND NOW MY FRIEND DOESN'T GET HER IPOD BACK FOR 2 WEEKS! AND THEY DON'T LET PARENTS COME GET IT.. CAN SOME ONE TELL ME IF THIS IS UNFAIR OR WHAT

My school crooms academy of intro to tech a highschool took my phone away for 9 weeks since it was my 3rd time getting it takin away. Everytime it got taken away though i was either turning it off ro down. This chool is a stupid b***h. If anyone reading this is thinking of going here dont. You would be better of going to prison where you get a minute of phone time. Is there no way that i can get my phone back legally?? Without fckn having to punch one of these a*****e in there nose??

So I got my phone taken for a week. This is the FIRST offense at mine. I wasn't using it during class either but during the passing period. and i was only checking it cause it was blowing up and i figured work was calling, i barely took it out of my pocket, i looked at the screen for like 1 brief second and it was confiscated. what the h**l! i pay like $100 a month for that! and yesterday, my car broke down, in the freezing weather far from home and i had No way of contacting anyone. THAT IS BULLSHIT! especially when i see people on their phones every day all day long. yes i understand there are rules and they need to be followed, but the consequences need some revision. At my school, if you have a parent try to come get it for you, the school Refuses to give it back until exactly one week is passed. A little too strict for me. what am i to do when another emergency arises? or when work calls me saying i need to come in? or when my bill is 126 goddamn dollars and i couldnt even use it for one f*****g WEEK!!!! f**k the school system i swear to god they are completely unreasonable and irrational. any teacher who has ever confiscated a cell phone for more than one day can go to h**l. in this day and age, it is simply illogical to think you can place restrictive bans regarding cell phone use. i think the school systems need to implement new rules & regulations and consequences for this issue such as not being able to use cell phones during tests. they say 'cell phones cause distractions' well... whats REALLY distracting me is the way they handled the situation. it has been on my mind non stop since they took it a few days ago; so much so, i have not been able to concentrate in my classes and its really making me want to just give up... i have barely done any of my work since it was taken and i maintain an above average GPA and i have never gotten a referral/detention in my life. im strongly against this policy as it makes no sense whatsoever. lol sorry for it being so long i just needed to Vent cause this is pissing me off!
