Question:

Can Property Managers do this?

I'm currently trying to sell my small business shop in a plaza. My lease is month to month and the potential buyer that I have says they won't buy without a lease. When I first told them about the Buyers and them wanting a new lease, the property manager said they'd have to check their credit history and background so the Buyers submitted the application and the Landlord says they would answer me back in two weeks. It has been more than 45 days now and now I'm being told the the Landlord has "bigger plans" for the plaza so they can't provide me an answer about the Buyers application. I'm worried that I can't even sell or possibly even lose my business now that they have "bigger plans". Is this possible?

  1. Yes, Get an attorney! Fast!

  2. You don't have a lease. Of course the owner can do this. It's the chance you take in business. They are only responsible for providing space on a month to month basis, not insuring the profitable sale of your business.

  3. it depends on what your contract states in the lease.  take it to a lawyer, quickly
