Question:

Can a 17 year old be a foreign exchange student in america even though he is allready in america illegally?

he came on a vistors visa but its expired. so is there anyway ican help him become a foreign exchange student so that he can study in the U.S. He is a reall smart kid i would like to help him. Can some one answer this question please!!

  1. There is nothing you can do. One of the conditions you agree to when you enter the US as a visitor is that you can not apply for a change of status.

    He'd need to leave the country, and reapply from home but the fact he's there illegally means that US Immigration may have not have him registered as having left the country, which could be help against him should he return home and apply legally.

  4. If he is such a smart kid, he wouldn't have overstayed his visitor's visa and have become an illegal alien.  

    No, there is no way to make himself a foreign exchange student since he is illegal in this country.  He must return to his own country and then request to come back.

  5. Hmmm... well he could just GO HOME and call that foreign exchange.  Otherwise, how is it foreign exchange if the person is already foreign?

He has to return to his own country in order to apply for a foreign student visa.  He will need documentation from the school that he has been accepted, and he must remain in his own country while the his visa application is processed, he is interviewed, etc.  He will be allowed to enter up to 30 days before classes start (for registration, etc. at school).

    The sooner he returns to his own country, the sooner he can start his education.  As it stands now, how long he will be barred from re-entry depends on how long he has been here illegally.  And there is NO way he can stay!

    Of course, he can always go to college in his own country.  There are good colleges in a great many countries.

    BTW, do NOT under any circumstances "help" him remain in the US.  You would be in violation of the "trafficking" law which prohibits "harboring," "sheltering," "transporting," etc.  Very steep fines plus up to 20 years in the federal pen.
