Can a Child born in India to an American mother apply for US Citizenship?

I am an Indian Citizen and my wife is an American Citizen. My wife's parents have moved back to India few years ago and thats how we got married here.

We have a son now who is 8 months old and I planned to get him a passport, so that I can travel with my family when I go on Business trips to USA/Europe.

With this scenario, I would like to know whether we can go for US Passport? That way I dont have to worry about getting him visas for most of the countries that I travel to. Please let me know for your suggestions.

  1. Yes, he can be filed as an American, it takes a small amount of money and proof of birth, etc., but doable.

    He needs no passport as a baby though.


  2. You should not have waited this long, although you should still be fine.

    As long as your wife lived in the United States for five or more years total, and as long as at least two of those years were after her 14th birthday, the child is eligible for American citizenship.  Both parents and the child will have to present themselves at the US Consulate.  Your wife should contact her embassy and ask to report a birth abroad.  They will be able to tell her what additional documents are required.

  3. i will save you years of waiting and money

    first both of you must go to the Court House in the county where you reside apply for your childs Passport (assuming your child has a tourist or green card or entry card to the US) fill out your childs application you will need to take both of your birth certificates and passports of each make sure that other than english documents are translated and certified. And you should recieve passport within 4 -8 weeks. This is According to the Child Act 2000, i do these process in my County it is legal and expedious..

    The American Citizen Services Unit accepts applications for Consular Reports of Birth Abroad on Tuesdays, Wednesdays and Thursdays at 10:00 a.m. by appointment only. A Consular Report of Birth Abroad is a certificate that states that the child is a U.S. citizen from birth.

    # For children born to one U.S. citizen and one foreign national, the U.S. citizen parent will need to show five years of physical presence in the U.S., two of which must be after the age of 14.  Examples of items that show physical presence are school transcripts, income tax returns with Form W-2, Social Security earnings history, pay receipts, passport entry/exit stamps in current and previous passports, etc.

    If also applying for a passport (see below) and only one parent is present in India, the other parent must complete a consent form. This form must be notarized.
